ARTICLE 1 – PURPOSE
The present terms and conditions govern the sale by la maison et des jardins de Claude Monet – Giverny of products
exclusively marketed on its website.
ARTICLE 2 – PRICES
The prices of our products are indicated net in euros. La maison et des jardins de Claude Monet – Giverny is not subject to VAT.In the event of an order to a country other than metropolitan France, you are the importer of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These duties and sums are not the responsibility of the Maison et Jardins de Claude Monet – Giverny. They are your responsibility, both in terms of declarations and payments to the competent authorities and organizations in your country. All orders, whatever their origin, are payable in euros. La maison et des jardins de Claude Monet – Giverny reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the price list in force at the time of validation of the order and subject to availability.Products remain the property of the Maison et Jardins de Claude Monet – Giverny until full payment has been received. When you take physical possession of the products ordered, the risks of loss or damage to the products are transferred to you.
ARTICLE 3 – ORDERS
Contractual information is presented in French and will be confirmed at the latest when your order is validated.
La maison et des jardins de Claude Monet – Giverny reserves the right not to register a payment, and not to confirm an order for any reason whatsoever, and more particularly in the event of a supply problem, or in the event of difficulty concerning the order received.
ARTICLE 4 – VALIDATING YOUR ORDER
Any order appearing on the website (https://claude-monet-giverny.fr) implies acceptance of these General Terms and Conditions.Any order confirmation implies your full acceptance of these General Terms and Conditions of Sale, without exception or reservation.
All data supplied and the recorded confirmation shall constitute proof of the transaction: you declare that you are fully aware of this.Confirmation of the order will constitute signature and acceptance of the operations carried out.A summary of your order information will be sent to you in PDF format via your order confirmation e-mail address.
ARTICLE 5 – PAYMENT
The fact of validating your order implies for you the obligation to pay the indicated price. Payment is made by credit card using the secure Paybox system, hosted by Crédit Agricole.

Payment is made in Euros only.The customer guarantees the seller that he/she has the necessary authorizations to use the chosen method of payment.
In the event of refusal of the card used by the payment center, the order is automatically cancelled.
ARTICLE 6 – RETRACTION AND RETURN
In accordance with the provisions of article L.121-21 of the French Consumer Code, the customer has a cooling-off period of 14 working days to exercise his legal right of withdrawal and return, at his own expense, the product(s) of his order which do not suit him, for whatever reason.
Products must be returned in their original condition, complete with packaging, accessories and instructions. In this case, you are liable. Any damage suffered by the product on this occasion may be such as to defeat the right of withdrawal.
To exercise your right to cancel all or part of your order, simply : Notify us of your right of withdrawal within 14 calendar days from the date on which you or a third party designated by you (other than the carrier) receives the product(s) ordered.You can notify us of your withdrawal by sending an email (or a letter) to the Returns Department, specifying the following information:
– Order number
– The date of receipt of your order
– The product(s) you wish to cancel
– Your surname, first name and postal address
– Your e-mail address

Products to which the right of withdrawal does not apply. In accordance with article L120-20-2 of the French Consumer Code, the right of withdrawal does not apply to audio or video recordings unsealed by the customer.
In accordance with the provisions of article L.121-21-8 of the French Consumer Code, the right of withdrawal does not apply to the supply of services fully executed before the end of the withdrawal period and whose execution has begun after prior express agreement by the consumer and express waiver of his right of withdrawal.
ARTICLE 7- AVAILABILITY
Our products are offered as long as they are visible on the website and within the limits of available stocks.
If a product is unavailable after you have placed your order, we will inform you by e-mail. Your order will be automatically cancelled and your payment will be automatically cancelled.
ARTICLE 8 – DELIVERY
Products are delivered to the delivery address indicated during the ordering process.
In the event of a delay in shipment, an e-mail will be sent to you to inform you of any consequences on the delivery time indicated.
In accordance with legal provisions, in the event of late delivery, you have the right to cancel the order in accordance with the terms and conditions set out in article L 138-2 of the French Consumer Code. If, in the meantime, you receive the product, we will reimburse you for it and the delivery costs in accordance with article L 138-3 of the French Consumer Code.
In the case of delivery by a carrier, the House and Gardens of Claude Monet – Giverny cannot be held responsible for late delivery due exclusively to the customer’s unavailability after several proposed appointments. Delivery times:
– Delivery in metropolitan France and Monaco: Colissimo (Delivery within 48 hours – working days)
– Delivery in Europe: Colissimo Europe (delivery within 3 to 5 working days)
– Delivery to other areas: Colissimo International (Delivery within 3 to 8 working days)
These delivery times are indicative and can be consulted on the www.coliposte.net website.
La maison et des jardins de Claude Monet – Giverny declines all responsibility in the event of a strike by the delivery services.
ARTICLE 9 – WARRANTY
All our products are covered by the legal guarantee of conformity and the guarantee against hidden defects, as stipulated in articles 1641 et seq. of the French Civil Code.
No product may be exchanged or reimbursed without the Vendor’s agreement and before it has been returned (preferably in its packaging) by the Customer to the Returns Department as soon as possible.
ARTICLE 10 – LIABILITY
The products offered comply with current French legislation. La Maison et des Jardins de Claude Monet – Giverny shall not be held liable in the event of non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with local authorities regarding the possibility of importing or using the products or services you intend to order.
Furthermore, la maison et des jardins de Claude Monet – Giverny cannot be held responsible for any damage resulting from misuse of the product purchased.
Finally, la maison et des jardins de Claude Monet – Giverny cannot be held responsible for any inconvenience or damage inherent to the use of the Internet network, notably a break in service, external intrusion or the presence of computer viruses.
ARTICLE 11 – APPLICABLE LAW IN THE EVENT OF DISPUTES
The language of the present contract is French. The present conditions of sale are subject to French law. In the event of a dispute, the French courts shall have exclusive jurisdiction.
ARTICLE 12 – INTELLECTUAL PROPERTYAll elements of the https://claude-monet-giverny.fr website are and remain the exclusive intellectual property of the House and Gardens of Claude Monet – Giverny. No one is authorized to reproduce, exploit, rebroadcast, or use for any reason whatsoever, even partially, elements of the site, whether software, visual or sound. Any simple link or hypertext link is strictly forbidden without the express written consent of the House and Gardens of Claude Monet – Giverny.
ARTICLE 13 – PERSONAL DATA

In accordance with the French Data Protection Act of January 6, 1978, you have the right to access, rectify and object to nominative information and personal data concerning you, directly on the website.
ARTICLE 14 – ARCHIVING PROOF
La maison et des jardins de Claude Monet – Giverny will archive order forms and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the French Civil Code.
The computerized registers of la maison et des jardins de Claude Monet – Giverny will be considered by all parties concerned as proof of communications, orders, payments and transactions between the parties.
